The High Court has ruled that Brian Bagyenda who is accused of killing Enid Twijukye has a case to answer.

In January 2016 Bagyenda and his two accomplices allegedly murdered his 22-year-old girlfriend Enid Twijukye at his home before dumping her body in a swamp in Namanve Mukono District.

They are Innocent Bainomugisha a cleaner and Vincent Rwahwire a casual labourer.

The prosecution alleges that Bagyenda and his co-accused on January 4th, 2017 at Njobe Road in Nakawa Division in Kampala District with malice aforethought caused the death of Twijukye a student of Makerere University Business School.

Justice Moses Kazibwe has on Friday ruled that Bagyenda and his co-accused have to defend themselves against the evidence produced to court by the 16 prosecution witnesses.

The witnesses include detectives, medical doctors, pathologists and the relatives of the deceased who pinned the accused of murdering Twijukye.

Three relatives of the deceased testified before Justice Moses Kazibwe that Bagyenda confessed to them about the murder.

Justice Kazibwe fixed January 14th, 2020 for the accused to start defending themselves.

The accused’s lawyer told the court that during the defense hearing, Bagyenda will present his sister Jane Francis Nantamu and Dr Brian Mutamba a Psychiatrist at Butabika Hospital as his witnesses.

Prior to the charges against Bagyenda, a medical report from Butabika shows he was admitted to the hospital on November 4th 2016  and diagnosed with major depressive episodes comorbid with suicidal ideation and anxiety symptoms.

However, he was treated and discharged in December 2016 before completing treatment.

The police surgeon, Dr. Santos Ojara on Wednesday told the court that shortly after Bagyenda committed the crimes, he was examined and found to be of a sound mind.
