The constitutional court has ruled in favor of Members of Parliament -MP’s to be appointed consequently as Ministers.

This follows a petition filed by 2 Lawyers in 2016 that the appointment of MPs to ministerial posts contravenes Article 113(4) of the Ugandan constitution.

In their petition, Wadada Isaac and Nsimbe Habib told the Constitutional court that Article 113(4)states that a Minister is not entitled to assuming an office that is likely to offer profits besides salary.

However, the 5 justices of the Constitutional court have all ruled against the petition.

Justices including Kenneth Kakuru, Irene Mulyagonja, Catherine Bamugemereire,Madrama Christopher, and the Deputy Cheif justice -CJ Richard Buteera in their judgment state that it is constitutional for the head of state to appoint Mps Ministers consequently.

They cite Article 113(1) of the same 1995 constitution that gives the president powers to appoint ministers.
