Bobi Wine false registration case

The Director of Public Prosecutions-DPP Jane Frances Abodo has withdrawn charges of false entry into Makerere University against National Unity Platform Party President Robert Kyagulanyi Ssentamu alias Bobi Wine.

According to the withdrawal form dated December 10, 2022, filed by the DPP, Jane Francis Abodo, the letter was presented before the Grade One Magistrate Marion Ninsiima, by the State attorney Joy Apolot. The letter doesn’t explain why the DPP made the decision.

Kyagulanyi was dragged to court by City lawyer Male Mabirizi in 2021, on charges of obtaining registration by false pretense for being admitted to pursue a Diploma in Music, Dance, and Drama (MDD) on mature-age entry illegally.

Kyagulanyi later graduated from Makerere University with a Diploma in MDD, which Mabirizi challenged saying he obtained it through a fraudulent process.

Mabirizi says Kyagulanyi who was then 20 -years- old, was on October 21st 2000 registered as a student of MDD on a mature age entry scheme contrary to Makerere University Prospectus of 1999/2000 -2000/2001.

The prospectus only allowed mature entry at a minimum age of 25 years or for one to have completed formal education at least five years prior to the year of admission.

The case was later taken over by the DPP on October 7 2021 following the evidence that was produced by Mabirizi.

Mabirizi hasd asked the court to summon Kyagulanyi to appear and answer the charges that attracts a one-year jail term if found guilty.

The Constitution permits the DPP to withdraw charges against an accused person in any court except the Court Martial at any stage of the case with exception when that case is pending judgment.

Mabirizi has asked the court not to endorse the withdrawal of the charges .

Kyagulanyi’s lawyer Geoffrey Turyamusiima told the court to disregard Mabirizi’s submissions arguing that he has no right to speak to court when at this stage of the proceedings he is being represented by the State which has decided to discontinue proceedings. He added that they were even willing to proceed.

Ninsima adjourned the case to February 14 2022 for the trial Magistrate Augustine Alule to make a decision.
