Two get 40 years in jail for attempting to murder six-year-old

The Chief Magistrate’s Court at Kayunga has convicted and sentenced Kivumbi Awali and Ngaswireki Paul to 40 years imprisonment for attempting to murder a 6-year-old boy.

The victim A.S aged 6 years was living with his grandparents in Busolo Village in Kayunga District and was a neighbour to Ngaswireki Paul and Kivumbi Awali both friends.

Court heard that on October 21, 2009, A.S went forgot his jackfruit near home but when he returned to collect it, he realized it had been cut and eaten.

A.S inquired about his jackfruit from the duo sitting next to its residues with two pangas but met a cold resistance. The accused persons instead chopped the minor on the head arm, shoulder and back leaving him in a comma.

A.S sustained a fractured skull, brain damage, and his right testis was harvested for purposes of human sacrifice. Medical examinations revealed and declared the victim’s right testis invalid.

The accused persons were arrested by the police and the Office of the DPP charged them with attempted murder contrary to Section 204 (a) of the Penal Code Act.

The Office of the DPP relied on both direct and circumstantial evidence to prove the case against the accused including evidence from the victim and the medical reports of the victim. Accordingly, the court found the two accused persons guilty and convicted them.

This case was committed two days before the passing of the Prevention of Trafficking in Persons (PTIP) Act, 2009, otherwise the accused would have been charged under the PTIP Act.

This was a retrial arising out of an appeal in the High Court at Mukono before Justice Margaret Mutonyi in which she ordered a retrial after the DPP appealed against the acquittal of the accused persons.

The matter was prosecuted by Edward Muhumuza – Chief State Attorney before Her Worship Sarah Tusiime – Chief Magistrate.
