The habeas corpus case filed by the former presidential candidate Robert Kyangulanyi Ssetama’s legal team has set a ruling for the 25th of January 2021.
City lawyers joined hands last week and petitioned the civil division high court headed by Justice Michael Elubu on the unconstitutional arrest of Bobi wine at his home which is not a gazetted area for arrests.
His lawyers led by the outspoken city lawyer Medard Lubega Ssenoga told the court today that Kyagulanyi and his wife Barbie Itungu are in illegal detention at their home in Magere Gayaza Wakiso District.
Court heard from Martin Mwambustya who represented the police director of operations Edward Ochom and the UPDF chief legal officer Gordon Busingye and they maintain that they are not in the custody of NUP presidential candidate Robert Kyagulanyi but only are only giving him security and limiting movements for misconduct.
Ochom and Busigye in their document also claim that Kyagulanyi has been violent during the campaign, leading masses to gather during rallies thus violating the COVID19 guidelines, rioting, undressing women, etc were all exhibited.
Mwambustya Further asked court that if incase its inclined to free Kyagulanyi stringent terms such as denouncing his planned processions with the youth and following covid19 guidelines.
Ssegona however, brushed off Ochom’s evidence saying its outdated and offends the rules of procedure.
