The High Court Civil division in Kampala has thrown out a bail application filed by Francis Onebe ,a businessman who was jailed for the murder of this wife Asio Immatulate Onebe.
Court presided over by Justice Paul Gadenya Wolimbwa deferred the application on grounds that Onebe would interfere with investigations and that he failed to satisfy court with his pleadings.
In a judgement read by the court registrar of the criminal division Didacus Muhumuza ,justice Gadenya sent his ruling objecting the bail application citing that if Onebe is given bail he will interfere with the investigations,he also says that the state is yet to conclude investigations into the case after it suffered major setbacks .
Justice Gadenya explains that one of the investigators died shortly before documenting evidence from investigations while another attempted to flee the country to London via Kenya under unclear circumstances.
Onebe had previously applied for bail in November 2021 on grounds that his health was bad and he needed to access treatment ,in addition,he told court he needed to supervise his daily businesses that employ over one hundred employees.
In hiis lawyer Moses Ingura beseeched the court that his client has a right to apply for bail since he has no offences in any court. He sighted out other grounds that his client was of advanced age and he wasnt fit to be in prison since he has even chronical diseases which needed treatment in Nairobi. Counsel for the applicant also said that his client has substantial sureties and he is a responsible who runs Pentagon security agency, and his absence makes work properly managed.
Upon denying them bail his lawyer Moses Ingura says right now they are going back to the drawing board but his client is in the bad situation and needs treatment.
