Besigye’s 30 m shillings cash bail appeal

Opposition strongman Dr. Kizza Besigye will have to stay longer at Kitalya government prison eating Posho and boiled beans as the High Court prepares to rule on his bail appeal.

The four time Presidential candidate was thrown into jail last week on his own terms after he declined a 30 Million Shillings cash bail ruling granted to him by the Buganda Road Grade One Magistrate.

He was slapped with charges of inciting violence on Thursday last week as he appeared before Grade One Magistrate Sienna Owomugisha. Besigye denied the charges and asked to be released on bail.

However he ditched the bail ruling on grounds that it was ‘outrageous’ and ‘unfair’ for the court to demand he pays an exorbitant sum of money while his co-accused paid only one million shillings each as bail for the same charge.

He directed his lawyer Erias Lukwago to file an appeal on the bail ruling which was done on Friday last week before the High Court.

Lukwago on told our reporter Rashidah Nakaayi on Monday morning that the High court will rule on the matter on Monday June 6, 2022 after both Defence and Prosecution have filed written submissions.

He says the Court has directed him to file written submissions on behalf of his client before close of business on Monday, while the Directorate of Public Prosecution (DPP) has up to Wednesday June 01 to present its written submission as well.

“The High Court has directed us to respond to the written submissions by the DPP after they file on June 01, so that the matter can be ruled on June 6, 2022. Let’s hope that all this goes as planned, the downside is Besigye has to stay longer in detention,” Lukwago says

Prosecution states that on May 24th, 2022 at Arua Park Muno Village Shauriyako Parish in Central Division in Kampala District, without lawful excuse at an assembly made statements to the members of the public indicating or implying that it would be desirable to demonstrate, an act which was reportedly calculated to lead to destruction or damage to property.

Joan Keko, State Attorney objected to bail saying that if Besigye’s records are known in court, it implies that he should desist from committing crimes that bring him to Court.
