Betty Bakireke Nambooze, the Mukono Municipality legislator has this morning finally appeared before Nakawa Chief Magistrate Court to answer to charges of Inciting the public to commit an offense.
This follows two sets of Criminal summons the Court issued against her in September and November, requiring her to appear today without fail.
However when she appeared before Presiding Grade One Magistrate Noah Ssajjabi, to know the Complainant in this case, Prosecution’s Racheal Nabwire was not present in Court, which Prompted Nambooze’s Lawyer Samuel Muyizzi Mulindwa to ask Court to dismiss the matter due to the State prosecutor’s absence.
Muyizzi noted that by the time the State dragged a tortured person to Court, contrary to the directive of the Chief Justice, it had evidence against her.
In his ruling Magistrate Ssajjabi declined to dismiss the case saying it would be unfair for Nabwire who has always appeared in Court ,even when the accused person decided to absent herself.
He then adjourned the matter to 7th/March/2019 with an order to State Attorney Racheal Nabwire who by this time had taken her sit, to come with witnesses on that day.
Nambooze who is still in pain but now able to move with clutches due to her permanently injured Spine, is alleged to have ,on 9th/June/2018, posted statements on Social Media, that allegedly incited the public to attack and murder public figures, alleging that however guarded they may be,government could not secure them.
Nambooze’s case stems from the death of the late Arua Municipality MP Ibrahim Abiriga who was gunned down a few meters away from his home in Kawanda.
Nambooze, who is out on bail, and plans to return to India after the festive season for further treatment,has since denied the charges.
