Bobi Wine dodges criminal summons

City Lawyer Male Mabirizi-Kiwanuka is at it again, suing the National Unity Platform boss Robert Kyagulanyi Ssentamu aka Bobi Wine for the fifth time in a row over inconsistencies in his age.

Mabirizi has petitioned the Nakawa Magistrates Court in Kampala to issue a warrant of arrest against Bobi Wine for obtaining a driving permit under false pretence.

Mabirizi contends that Bobi Wine in obtained a Class B driving permit on August 3 indicating that he was born on February 2, 1982 ,contrary to some of his academic documents that place his birth date on February 2, 1980.

Mabirizi wrote to the Chief Licensing Officer, Motor Vehicles under the Ministry of Works and Transport seeking certified copies of the signed application for driving license and renewals for Kyagulanyi. The letter that was written on August 30, 2020, received a reply on September 10, the same year.

Mabirizi claims that birth date of 2 February 1980 is documented in his 1996 Uganda Certificate of Education – UCE entry form at Kitante Hill School, the 1997 admission record at Kololo Senior Secondary School and his registration forms at Makerere University.

He now wants the court to summon the accused to answer for his dishonesty.

“The crime now is the contradiction of two years, it contradicts Sec 115 of the penal code act that brings false information and obtaining information by false pretense. This is a new case, the driving permit was obtained from Kyambogo, Ministry of Works and Transport and within the jurisdiction of this court. he says

Mabirizi says he opted for a warrant of arrest because Bobi Wine has a bad track record of deliberately avoiding court summons and this was done to see if he fails to appear before the court.

“I have asked the presiding Magistrate to issue a warrant of arrest this time because I have proved by affidavit that Kyagulanyi has never accepted any criminal summons by court ,I have informed court that in Wakiso ,he never respected criminal summons ,at the LDC ,he also never appeared .So this is the only way he can appear,”he said  

Recently,the Directorate of Public Prosecutions (DPP) threw out a case of false entry into Makerere University against Bobi Wine filed by Mabirizi.

According to the withdrawal form dated December 10, 2022, filed by the DPP, Jane Francis Abodo, the letter was presented before the Grade One Magistrate Marion Ninsiima, by the State attorney Joy Apolot. The letter didnt explain why the DPP made the decision.

Kyagulanyi was dragged to court by Mabirizi in 2021, on charges of obtaining registration by false pretense for being admitted to pursue a Diploma in Music, Dance, and Drama (MDD) on mature-age entry illegally.

Kyagulanyi later graduated from Makerere University with a Diploma in MDD, which Mabirizi challenged saying he obtained it through a fraudulent process.

Mabirizi says Kyagulanyi who was then 20 -years- old, was on October 21st 2000 registered as a student of MDD on a mature age entry scheme contrary to Makerere University Prospectus of 1999/2000 -2000/2001.
